TERMS AND CONDITIONS READERS WAREHOUSE RETAIL STORES
Products and availability
1. A range of Products including books, games, DVDs, CDs, toys, games and stationery are available for purchase at our stores.
2. Stocks are limited of all products in stock, and pricing may change without prior notice.
Payments by you
1. All prices include Value Added Tax at the rate of fifteen per cent (15%).
2. We accept cash payments, credit card and debit card payments.
2.1 We do not allow payment to be done via cheque or EFT.
1. Most special order products which are required to be ordered in from local suppliers are dispatched within seven (7) to ten (10) working days after receipt of such payment confirmation.
2. An order will not be placed until payment has been made.
3. Should a delay or stock shortage occur after your order has been placed, we shall notify you as soon as possible.
Defective products
1. A defect is a material imperfection in the manufacture of a Product or in any characteristic of the Product, which renders the Product less acceptable than one would reasonably be entitled to expect. A defect does not include:
1.2 Faults arising from normal wear and tear;
1.3 Damage arising from incorrect, negligent or abusive use of a Product;
1.4 Damage arising from electrical surges or sea air corrosion;
1.5 Damage arising from failure to adequately care for the Product;
1.6 Damage arising from unauthorised alterations to the Product;
1.7 Where the Product specifications, although accurately described on the Website and generally fit for the Product’s intended purpose, do not suit you;
1.8 Flat batteries in a battery-operated item. It is your responsibility to replace batteries with fresh batteries as necessary;
Clearance Products
1. Any damage or defect in a “Clearance bin” item sold in the store. These Products are excess stock or shop-soiled items, sold at heavily discounted prices, on the understanding that they may be damaged or defective in various ways.
2. When purchasing a product offered in defective condition, you do so on an “as is” basis and agree to accept it in a defective state. As a general rule, you are not entitled to return the item on the basis of the defect/s concerned, EXCEPT when the item is misbound or is missing pages (and therefore not readable).
General procedure for defect returns:
1. You agree to inspect your product before making a purchase. If defect/s in the product only become apparent after you have taken purchased it, then you should report full particulars thereof to us immediately, but in any event within forty-eight (48) hours of purchase.
2. In most instances, failure to report a defect in a product within forty-eight (48) hours of making a purchase will give rise to a reasonable apprehension that any defect was produced after you made purchase of the product. We cannot be held liable for defects which have arisen subsequent to your marking purchase of the item.
3. Within six (6) months from your receipt of a defective product, you are entitled to return the product to us and receive a replacement product (if available), credit or refund (in full or in part), in terms of the following procedure only.
4. A defective product may be returned to us as the store you made the purchase from or in any other instance, by our courier at our risk and expense, and:
4.1 It must be in its original condition and missing no accessories or parts;
4.2 It must be accompanied with its original receipt received when making the purchase, as well as your indication as to whether you would prefer a replacement product or a credit or refund.
4.3. We shall inspect the product and, if the product is found to indeed be defective then:
4.3.1. in the case of a DVD or CD or other audio or video recording or computer software, we will only be able to offer an identical replacement item in lieu of the defective item returned to us. We cannot offer a credit or refund for copyright reasons;
4.3.2. in any other case we shall action your request for a replacement product (if available) or a credit or refund either for the value of the purchase price or a reasonable portion thereof, determined by us having regard to the extent of the defect in the item (and, for example, whether the item could nevertheless be read or used, or was not capable of being read or used despite the defect).
1. In accordance with the Electronic Communications and Transactions Act, you are entitled to return your purchase without supplying a reason, and receive at your election a credit to your account or refund less only the cost of returning the Product to us, by logging a return request on the Website within seven (7) calendar days of receipt of the Product concerned, unless the Product is:
1.2 One intended for everyday consumption;
1.3 Personalised for you or made to your specifications;
1.4 An eBook or other digital download, or a DVD or CD or other audio or video recording or computer software which has been unsealed; or
1.5 A book, newspaper, periodical or magazine.
2. Despite the aforegoing, you are entitled to return your purchase of a book, newspaper, periodical or magazine without supplying a reason, and receive a credit to your account less only the cost of returning the Product to us, by returning the purchase to your closest Readers Warehouse Store within forty-eight (48) business hours of purchase of the Product concerned, unless the book or similar product:
2.1 has been sourced for you as an international import or special order; or is an academic publication or textbook.
3. When returning the product;
3.1. The Product must be in its original condition and original unopened packaging (if applicable), and missing no accessories or parts
3.2. It must be accompanied by its original delivery note or order receipt, which will be included with your order.
1. Any refund due to you shall be paid, if you made payment by credit card, to that credit card account. No refunds shall be paid into third party accounts.
